Calibration Drift
The Intoxilyzer 5000 EN, currently used in Texas has never been proven to be calibrated properly. The Texas Department on Breath Testing Regulations would like for us all to believe that they have thoroughly vetted the machine, but unfortunately, that is not the case. What they have done is relied on their Technical Supervisors to "check for calibration" a few times a month. Amazingly, the machines are never out of calibration!!!!!!
The truth is that all machines with same or similar technology need to be calibrated frequently. Even when the machines are calibrated properly, as opposed to checking for calibration, they still have a tendency to drift out of calibration. This means that if the machine has not been calibrated and has drifted out of calibration, the technical supervisor has no way of knowing that because calibration itself is not a self-checking feature on the machine. If it drifts out of calibration, it will remain so indefinitely.
What does this mean to you? That your breath test may be completely invalid.

And the technical supervisor's in Texas are only checking for calibration and this is only done a couple of times a month.
