Trooper Phipps not credible affirmed by Court of Appeals

On July 15, 2009, the 9th District Court of Appeals affirmed Montgomery County Court at Law Number Four Judge Mary Ann Turner's decision to suppress evidence obtained and testimony from Trooper Troy Phipps. Judge Turner simply did not believe Trooper Phipps was telling the truth, under oath during a suppression hearing held in her court. Defense Attorney Gilbert Garcia represented the accused in the motion to suppress and did a masterful job of showing the court how Trooper Phipps testimony changes, depending on the circumstance.

Does this mean Trooper Phipps will be prosecuted for perjury?

Will Trooper Phipps suffer an official reprimand form the Texas Department of Public Safety?

Will he be reassigned or retrained in any way?

Well it's been over a year since I first wrote about this and so far, it's life as usual for the dishonest law enforcement officer. As long as he can do his job, continuing to obtain convictions for the State, does it matter if he is dishonest? Does it matter if innocent people are wrongfully accused and convicted?

It will when you are the person he wrongfully accuses! Make a difference and contact the District Attorney's Office and DPS and call to complain about this sort of behavior from your law enforcement officers. Expect a lot more from your police and you will get more out of them.
